Addition to the Municipal Property Tax forces couples to state if they want joint taxation for this tax. If they don’t do this until the end of May, they pay more. Tax experts condemn this “trapdoor” to charge additional revenue.

The Addition do the Municipal Property Tax, that went to get known as “Mortágua Tax”, in reference to the Bloco de Esquerda deputy that announced it, raises constitutional doubts and may be objected in several courts. At issue is the obligation of couples to hand in a declaration to the tax office specifying if they want joint taxation in the billing of this tax levied on properties above 600.000 euros.

For tax experts of Rogério Fernandes Ferreira & Associados the addition of this obligation to the law of the Addition to the Municipal Property Tax, when the tax office already  knows that joint taxation is always more favorable, is highly questionable on a constitutional point of view and will have the aim of charging further.
